1. Agreement to Terms

By accessing and using IT Tech Lux’s website and services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.

2. Services

IT Tech Lux provides web design, web development, website hosting, software licensing, and related IT services. Specific terms for each service may be outlined in separate service agreements.

3. User Responsibilities

You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Comply with all applicable laws and regulations
• Not use our services for illegal purposes
• Not interfere with or disrupt our services
• Not attempt to gain unauthorized access to our systems

4. Payment Terms

Pricing

All prices are quoted in Euros (EUR) unless otherwise specified. Prices are subject to change with notice.

Payment Schedule

For project-based work, payment terms will be specified in the project proposal. Hosting and recurring services are billed in advance according to the selected billing cycle.

Late Payments

Overdue invoices may result in suspension of services. A late fee may be applied to overdue accounts.

5. Refund Policy

Custom development work is non-refundable once work has commenced. Hosting services may be eligible for prorated refunds within the first 30 days. Software licenses are non-refundable once delivered.

6. Intellectual Property

Client Content

You retain all rights to content you provide to us. By providing content, you grant us a license to use it for the purpose of delivering our services.

Deliverables

Upon full payment, you own the final deliverables (websites, applications, etc.) created specifically for you. We retain ownership of any pre-existing code, templates, or tools used in the project.

Our Property

All materials, processes, and methodologies we use remain our intellectual property.

7. Hosting Services

Uptime Guarantee

We guarantee 99.9% uptime for hosting services. Credits may be issued for verified downtime exceeding this threshold.

Acceptable Use

Hosted websites must comply with our Acceptable Use Policy. Prohibited activities include illegal content, spam, malware distribution, and excessive resource consumption.

Backups

While we perform regular backups, you are responsible for maintaining your own backups of your data.

8. Warranties and Disclaimers

We warrant that our services will be performed in a professional manner. However, we provide services “as is” without warranties of any kind, express or implied.

We do not guarantee that our services will be uninterrupted, error-free, or meet all your requirements.

9. Limitation of Liability

To the fullest extent permitted by law, IT Tech Lux shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

10. Termination

Either party may terminate services with 30 days’ written notice. We may terminate immediately for breach of these terms or non-payment.

Upon termination, you must pay for all services rendered. We may delete your data after termination in accordance with our data retention policies.

11. Confidentiality

We will keep confidential any proprietary or sensitive information you share with us in the course of providing services.

12. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the new terms.

13. Governing Law

These terms are governed by the laws of Luxembourg. Any disputes shall be resolved in the courts of Luxembourg.
